Legality of Mobile Gambling

Legality of Mobile Gambling

Wednesday, May 6, 2009 | By CasinoGuide

Mobile gambling is a great new way to enjoy online casino action. Not only do you not have to travel to a brick and mortar casino to play craps, roulette, blackjack and the rest, you don't have to stay at home either.

With a mobile device and mobile gambling software, you can make any place, from your dinner table to a city bus, into a fully functional casino. But is it legal? What are the legal issues surrounding mobile gambling?

The UIGEA

In the United States, the Unlawful Internet Gambling Enforcement Act, which applies to online gambling, applies to mobile gambling as well.

However, this does not necessarily present a problem for mobile gamblers. The relevant part of the act simply makes it illegal for banks to make financial transfers to online gaming sites.

It does not make it a crime for you the consumer to play on the site. However, since banks and online casinos may be at risk, this may make it difficult to get some banks and some mobile casinos to be willing to take on U.S. customers.

Outside the U.S.

In general, one should expect anywhere that online gambling is illegal, mobile gambling is illegal. If you are in a foreign country, you should find out their Internet gaming laws before you start playing any mobile casino games. By the same token, if there are no restrictions on Internet gambling in your country, you shouldn't have anything to worry about when gaming on your cell phone.

In Nevada

Some casinos in Nevada, particularly the Venetian, are experimenting with allowing mobile gaming. Since the mobile gaming headquarters for these programs are located in Nevada, where casino gambling is legal, these casinos seem to have skirted the UIGEA issue. If you are in Nevada, you should look into mobile gaming options, although many in Las Vegas will want to take advantage of their geographic location by playing in an actual, brick and mortar casino.

The legal landscape for gambling is constantly changing as attitudes and technological options evolve. Whatever the legal situation is now may change at any time, so interested gamblers should try to stay abreast of new developments in this world.
